Welcome to Rimbi. These terms govern the use of the Rimbi app and the rimbi.app website (together, “the Service”) and the sale of the paid plans. By creating an account or using the Service, you accept them.
1. Who are we?
The Service is published by SECRETARAI, SASU with share capital of 50 €, registered with the Nice Trade and Companies Register (RCS) under number 103 272 100, with its registered office in Nice (06200) (see the legal notice). Contact: [email protected].
2. Definitions
- User: any person who uses the Service, with or without an account.
- Group: a set of people (family, friends, colleagues…) brought together in the Service.
- Event: an occasion (Christmas, birthday, birth, wedding…) organized in a group: a draw, a group gift, or both.
- Organizer: the User who creates a group or an event, or to whom this role has been handed over; co-organizers have the same management rights.
- Draw: the random assignment, under the rules chosen by the Organizer, of the person or people to whom each participant gives a gift.
- Child profile: the profile of a child without an account, created and managed by a parent.
- Guest: a person who takes part in an event from the web page, without an account, using the personal link and code they received.
- Content: everything Users publish (messages, ideas, wish lists, photos, polls…).
3. Access to the Service
3.1. You must be at least 15 years old to create an account. Younger people take part through a Child profile created by a parent or by the person who holds parental authority, who remains responsible for it.
3.2. By creating a Child profile, the parent guarantees that they hold parental authority over the child and undertakes to enter only the information that is useful to the Service.
3.3. By inviting a person without the app, the Organizer guarantees that they are in contact with that person and that the person expects to receive the invitation. The link and code are sent to them directly; the Organizer does not see them. They are valid for 7 days (Article 13).
3.4. The Service is available free of charge, within the limits of the free plan (Article 10). Internet access and your device remain at your own expense.
4. Your account
4.1. You agree to provide accurate information and to keep your password confidential. An account is personal: one person, one account.
4.2. You can turn on locking with Face ID or fingerprint, and two-factor authentication. Biometric recognition is performed by your phone: we never have access to it.
4.3. Let us know without delay if you suspect fraudulent use of your account. You can remotely sign out your other devices from the app.
5. How draws work
5.1. The Draw is carried out automatically, at random, following the rules chosen by the Organizer (exclusions, no reciprocal draws, budget, number of people, memory of previous years). If the rules make the draw impossible, the Service flags this before drawing.
5.2. The draw is secret: each participant only sees their own assignment. The Organizer and administrators do not see other people’s draws, unless the Organizer has chosen, before the draw, the “open” mode or the reveal of the whole chain after the event. These choices are visible to all participants and can no longer be changed once the draw has been made.
5.3. After the Draw, the Organizer can add or remove a participant through a “discreet adjustment” that changes as few assignments as possible, or redo the draw. The participants concerned are informed.
5.4. The Service helps organize the gift exchange; it does not guarantee that each participant actually gives a gift, nor the gift’s value. The budget shown is a recommendation.
6. Group gift and payments between members
The Service lets you track contributions to a group gift and display a link to an external money pot (Lydia, PayPal, bank transfer…). Rimbi never collects, holds or transfers money between Users. Payments made through these external means are governed by the terms of their providers and are the sole responsibility of the Users concerned.
7. Rules of conduct and moderation
7.1. You agree to use the Service respectfully. The following are prohibited in particular: insults, harassment, threats, hateful, racist, sexist, homophobic or discriminatory remarks, violent, pornographic or illegal content, impersonation, publishing a third party’s data without the right to do so, spam, and any attempt to circumvent the Service’s security or to discover someone else’s draw.
7.2. Automatic moderation: before they are published, discussion messages and secret messages are analyzed automatically (a word list and a text analysis model) to block hurtful remarks. A blocked message is not published and you are informed of this; after several attempts, the discussion is closed to you for 24 hours.
7.3. Reporting: every User can report Content from the app, or by email to [email protected]. We review reports diligently. The Organizer can also delete a message in their event and mute a participant.
7.4. Decisions and appeals: if we remove Content or restrict an account, we tell you the reasons, unless a legal exception applies. You can challenge any decision by writing to us at [email protected]; your complaint is reviewed by a human.
7.5. In the event of a serious or repeated breach, we may suspend or delete your account, after informing you, except in an emergency or where required by law.
8. Your content
You remain the owner of your Content. You authorize us to host, reproduce and display it to the people it is intended for, solely to operate the Service, for as long as necessary. You guarantee that you hold the rights to the Content you publish (in particular photos).
9. Availability and liability
9.1. We make our best efforts to keep the Service available and working properly, but cannot guarantee uninterrupted availability (maintenance, failure of a service provider, force majeure). Draws scheduled during an interruption are carried out as soon as the Service is back.
9.2. We cannot be held liable for exchanges, gifts and payments between Users, nor for Content published by Users of which we were not aware. Nothing in these terms limits the rights the law grants you as a consumer.
10. Plans and prices
10.1. Free plan: 1 organized group, up to 20 people (children included), all features included.
10.2. Paid plans, reserved for the Organizer, with the other members having nothing to pay:
- Family: annual subscription, up to 5 groups of 50 people;
- Tribe: annual subscription, up to 20 groups of 150 people;
- Event Pass: one-time purchase that raises a group to 50 people for one event, until 30 days after that event.
10.3. Prices are shown in the app including all taxes, in your country’s currency, before any purchase. They may vary by country and change over time; a price change never applies to a period already paid for, and you are informed of it before the next renewal.
10.4. Removing someone, correcting a mistake or deleting a group never costs anything.
11. Purchase, renewal and cancellation
11.1. Purchases are made through the purchase system of the App Store (Apple) or Google Play (Google), under their terms. We never receive your bank details.
11.2. Subscriptions renew automatically for one year, unless you cancel at least 24 hours before the renewal date. We remind you of the renewal date no earlier than three months and no later than one month before it, together with the deadline to cancel.
11.3. It is easy to cancel: Profile › My subscription › Cancel takes you straight to your app store’s subscription management. Cancellation takes effect at the end of the paid period; you keep your plan until then.
11.4. When a subscription ends, nothing is deleted: groups beyond the free limits become “paused” (they can be viewed, but no new draw or new member is possible) until a new subscription is taken out.
12. Right of withdrawal
As a consumer, you in principle have 14 days to withdraw from a distance purchase. By requesting immediate access to your plan, you agree that it starts before the end of this period and acknowledge that you lose your right of withdrawal once the service has been fully provided (article L221-28 of the French Consumer Code). For a purchase made on the App Store or Google Play, refund requests are made to the platform, under its terms; you can also write to us and we will help you with the process.
13. Codes, gift codes and gifted access
13.1. All codes are valid for 7 days from their creation (or from when they were last resent): group invitation codes and links, links and codes for guests without the app, free or paid gift codes, codes for taking over a child profile. After this period, they are deleted, whether used or not, and can no longer be used. Whatever a code has already provided (joining a group, a plan, a profile taken over) is kept.
13.2. A gift code gives access to a plan for the stated duration (sometimes for life). It is personal and single-use, and can be neither resold nor exchanged for money. After 5 incorrect codes, entry is blocked for 15 minutes. Access gifted “for life” applies for the entire period during which the Service is operated.
14. Mediation and disputes
If you run into a problem, write to us first at [email protected]: we always look for an amicable solution.
If your written complaint does not resolve the matter, you can use, free of charge, the consumer mediator we are affiliated with: [TO BE COMPLETED: name, address and website of the mediator], within one year of your complaint.
15. Deleting your account
You can delete your account at any time from Profile › Data & privacy › Delete my account. Deleting an account does not cancel a subscription taken out on an app store: remember to cancel it (Article 11.3). If you organize groups, you will be able to hand over your role before leaving.
16. Personal data
We process your data in accordance with our privacy policy.
17. Changes to the terms
We may change these terms. If a change is significant, we will let you know in the app at least 30 days before it takes effect; you can then delete your account if you do not agree.
18. Governing law
These terms are governed by French law. If you live in another European Union country, you keep the protection of the mandatory rules of your country’s law. In the event of a dispute, and failing an amicable solution, the competent courts are determined according to the legal rules; as a consumer, you may bring the matter before the court of the place where you lived at the time of the purchase or of the event that caused the damage.
